Terms & Conditions

1. Application
These terms govern your use of the https://lamottagroup.au website and any services provided by La Motta Group Pty Ltd (La Motta Group, "we", "us", "our") to clients ("you", "your"). By engaging us, you agree to these terms.
2. Quotes
All quotes are provided free of charge and without obligation. Quotes are valid for 30 days from the date of issue. Quoted prices are based on the scope of work, site conditions and access at the time of the on-site measure. If site conditions change before work commences, we reserve the right to revise the quote.
3. Acceptance and deposit
A quote is accepted by signed agreement and payment of an agreed deposit. The deposit secures the materials order and a position in our build schedule. Deposit amounts are detailed in the quote.
4. Site access and preparation
You must provide safe, clear and lawful access to the work site for the duration of the project. You are responsible for identifying and clearly marking the location of underground services (water, gas, electrical, telecommunications) prior to work commencing. We use Dial Before You Dig (1100) for service location confirmation but ultimate responsibility for accurate marking rests with the property owner.
5. Workmanship warranty
We warrant our workmanship for 12 months from the date of project completion. This warranty covers defects arising from poor installation but does not cover damage caused by:
- Storms, floods, fire or other natural events
- Vehicle impact or third-party damage
- Movement or settling of soil, retaining walls or footings outside our scope
- Normal weathering, fading or seasonal timber movement
- Modifications, repairs or attachments made by others after completion
Materials carry their manufacturer's warranty, where applicable, which we will pass on to you.
6. Payment
Payment terms are detailed in the quote. Final invoices are due within 7 days of project completion unless otherwise agreed in writing. Late payments may incur interest at 10% per annum from the due date.
7. QBCC licensing and consumer rights
La Motta Group Pty Ltd holds Queensland Building and Construction Commission Licence 15 342 689. Our work is regulated under the Queensland Building and Construction Commission Act 1991. Nothing in these terms excludes, restricts or modifies your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or the Queensland Building and Construction Commission Act, including your statutory consumer guarantees.
8. Variations
Any changes to the agreed scope of work must be confirmed in writing (including by email or text message) before the variation is performed. Variations may incur additional cost and may extend the project timeframe.
9. Photography and marketing
We may photograph completed work for use in our portfolio, social media and marketing materials. We will not include identifying property details (street numbers, signage) without your consent. Please notify us in writing before work commences if you do not consent to project photography.
10. Cancellation
If you cancel a project after the deposit has been paid, materials already ordered or delivered will be charged at cost. Work performed up to the cancellation date will be invoiced in full.
11. Dispute resolution
If a dispute arises, please contact us first to discuss — most matters can be resolved directly. If we cannot resolve the dispute, you may refer the matter to the Queensland Building and Construction Commission (qbcc.qld.gov.au) or the Queensland Civil and Administrative Tribunal (qcat.qld.gov.au).
12. Governing law
These terms are governed by the laws of Queensland, Australia. Any legal proceedings must be brought in the courts of Queensland.
